Agreement to terms
By downloading, installing or using the Placemoir app for iPhone and iPad (“App”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the App.
These Terms are a legally binding agreement between you (“you” or “your”) and Tweeting Birds LLC (“Tweeting Birds,” “we,” “us” or “our”).
Changes to these terms
We may change these Terms from time to time, for example to reflect new features or changes in the law. We'll tell you about significant changes before they take effect, through App Store update notes, a notice in the App, or by updating this page with a new “Last updated” date. If you keep using the App after a change takes effect, the new Terms apply. If you don't agree, stop using the App. Changes do not apply retroactively.
What Placemoir does
Placemoir is a private journal for the places you visit. It lets you:
- Save places, such as restaurants, hotels, parks, museums and attractions, using Apple Maps search or your current location
- Import places from the photos you pick or from a Google Maps export
- Log visits with the date, time, weather, your rating and notes
- Attach photos, voice memos and files to a visit
- See your places on a map, search your journal, and keep a Want to go list
- Lock the App with Face ID
- Export your journal, or delete all of it
- Optionally sync your journal across your devices with iCloud
Some features depend on your device, operating system, region or settings, and may not be available everywhere.
Acceptable use
You may
- Use the App for personal, non-commercial purposes
- Create and store your own entries, photos, recordings and files
- Sync your journal with your personal iCloud account
- Export your journal and keep or share the export as you like
You may not
- Use the App for any illegal or unauthorized purpose
- Record other people without their consent where the law requires it
- Store content that is illegal or violates others' rights
- Reverse engineer, decompile or attempt to hack the App
- Circumvent or bypass any security features
- Resell or redistribute the App
- Use automated systems to access or scrape the App
Your content
- You own the entries, notes, photos, recordings and files you create or add (“your content”)
- You are responsible for your content and for having the right to store anything you add, such as photos or files from others
- Your content is stored on your device and, if you turn on iCloud sync, in your personal iCloud account. We do not have access to it
- Because your content never reaches us, you do not grant us any license to it
- You are responsible for keeping a backup. You can export your whole journal at any time from You › Export journal
Places, maps and weather
Place names, addresses, categories and maps come from Apple Maps, and weather comes from Apple Weather. This information is provided for your convenience and may be incomplete, out of date or wrong. Check anything important, such as opening hours or directions, before you rely on it. We are not responsible for the accuracy of information provided by these services.
Intellectual property
The App's design, features, code, artwork and branding, including the Placemoir name and ribbon mark, are owned by Tweeting Birds and protected by copyright, trademark and other laws. You may not copy, modify or distribute any part of the App without permission.
License
As long as you follow these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, for personal, non-commercial purposes. You may not copy or modify the App, create derivative works from it, remove proprietary notices, or transfer, sublicense or resell your access to it.
Purchases
- Any purchase of or in the App is processed by Apple through the App Store and is subject to Apple's terms
- Payment is charged to your Apple Account when you confirm the purchase, and the price shown at that time is the price you pay
- Except as required by law or Apple's refund policies, all sales are final. Refund requests go to Apple at reportaproblem.apple.com; we do not process refunds directly
- Nothing in these Terms limits any right you have under the law of your country, such as a statutory right to withdraw from a purchase
iCloud sync
- iCloud sync is optional, requires an iCloud account, and is subject to Apple's iCloud terms
- Your journal, including photos and voice memos, counts toward your iCloud storage
- Sync uses Apple's CloudKit, needs an internet connection, and is encrypted in transit and at rest
- We are not responsible for sync failures caused by iCloud
- Turning off sync does not delete data already in iCloud; manage it in your device's iCloud settings
Privacy
Our Privacy Policy explains how we handle information and is part of these Terms. In short: the App does not collect your journal or information that identifies you, your content stays on your devices and in your iCloud account, and we never sell data.
Disclaimers and limitation of liability
“As is”
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR NEEDS, THAT ERRORS WILL BE CORRECTED, OR THAT YOUR DATA WILL NOT BE LOST OR CORRUPTED.
Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWEETING BIRDS IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR USE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP AND IN-APP PURCHASES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence, fraud, gross negligence or willful misconduct. If you are a consumer in the European Union, the United Kingdom or another country whose law gives you rights that cannot be waived by contract, nothing in these Terms affects those rights.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Tweeting Birds and its members, managers, employees and agents from third-party claims, losses and expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms or of anyone's rights, or your content.
Third-party services
- Apple: the App is distributed through the App Store and uses Apple Maps, Apple Weather, iCloud and Face ID, each subject to Apple's terms. Apple is responsible for those services
- Apple Weather: weather information is provided by Apple Weather and subject to Apple's terms and its data source attribution
- Google Maps exports: files you export from Google with Google Takeout are subject to Google's terms. Placemoir reads them on your device and does not connect to Google
- Links: the App or this website may link to sites we don't operate. Their own terms and privacy policies apply
Feedback
If you send us ideas or suggestions about the App, you agree we may use them without any obligation to you. This gives us no rights to your journal.
Termination
You can stop using the App at any time by deleting it. We may suspend or end your license if you materially violate these Terms, and we may change or discontinue the App or any feature, with reasonable notice where practical. If we discontinue the App, we'll try to give you notice in advance so you can export your journal. When your license ends, you must delete the App; your content stays on your device and in iCloud until you delete it. Sections that by their nature should survive termination, such as intellectual property, disclaimers, limitation of liability, indemnification and dispute resolution, survive.
Children
The App is not directed to children under 13. If you are under 13, do not use the App. If you are under 18 (or the age of majority where you live), you need a parent or guardian's permission to use the App and make purchases.

Dispute resolution
Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. If you are a consumer living outside the United States, you also keep the protection of any mandatory consumer law of the country where you live.
Informal resolution first
Most concerns can be solved quickly by email. Before starting any formal proceeding, you and we each agree to try to resolve the dispute informally for at least 60 days, starting when one of us sends the other a written notice describing it. Send your notice to [email protected].
Class action waiver
To the extent permitted by law, you and we each agree to resolve disputes individually and waive any right to bring or join a class, collective or representative action. If this waiver is found unenforceable for a particular claim, only that claim is affected.
Jurisdiction
Any claim not resolved informally must be brought in court. Either of us may bring an individual claim in small claims court if it qualifies. Otherwise, you consent to the exclusive jurisdiction of the state and federal courts located in or serving Cherokee County, Georgia, except that a consumer living outside the United States may bring a claim in the courts where they live if the law there gives them that right.
General
- Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and Tweeting Birds about the App
- Severability: if any provision is unenforceable, it will be enforced to the maximum extent permitted and the rest stays in effect
- Waiver: not enforcing a provision is not a waiver of it
- Assignment: you may not transfer these Terms. We may assign them, for example in a sale of the App, if the assignee agrees to be bound by them
- Force majeure: we are not liable for failures caused by circumstances beyond our reasonable control
- Notices: because Placemoir has no accounts, we may give notice in the App, in App Store update notes, on this website, or by email if you have written to us
